Democratic Call to Caucus
70th House of Delegates District
City of Richmond, Henrico County, Chesterfield County Virginia

Whereas, it is the duty of the 70th House of Delegates District Nominating Committee to issue the Call to Caucus for the purpose of nominating the Democratic candidate for the 70th Virginia House of Delegates Special Election of January 6, 2009.

Now therefore be it resolved that the 70th House of Delegates District Nominating Committee, hereby issue the Call to Caucus for an Unassembled Caucus for Saturday, December 6, 2008 1:00 pm to 4:00pm.at the following locations:

31st Street Baptist Church, 823 N. 31st Street, Richmond, Virginia; and,
Math & Science Innovation Center, 2401 Hartman Street, Richmond, VA;

for the sole purpose of nominating the Democratic Party candidate for the Virginia House of Delegates 70th District Special Election to be held on January 6, 2009, and the following provisions shall govern the convention, to wit:

1. Declaration of Candidacy and Candidate Filing Fee

All candidates for the Democratic Party nomination for the office listed above shall file a declaration of candidacy and a candidate filing fee of $600 on or before 5:00 p.m., Thursday, December 4, 2008. The candidates shall fill a Declaration of Candidacy for Democratic Nomination and 125 signatures on the Commonwealth of Virginia Petition of Qualified Voters form (available at http://www.sbe.virginia.gov/cms/documents/PetitionForm.pdf), with the 70th House of Delegates District Nominating Committee Chair, Ophelia Daniels. Said Declaration, Petition, and Fee shall be delivered to delivered to Ophelia Daniels, at 938 W. Grace Street, Richmond, VA 23220 All payments shall be made payable to the Richmond City Democratic Committee. Only those candidates properly pre-filed may have their names placed on the ballot.

2. Notice Requirements

The 70th House of Delegates District Nominating Committee shall meet notice requirements of the Party Plan by placing this call on the websites of the City of Richmond, Henrico County, Chesterfield County, and Democratic Party of Virginia websites and shall issue a press release to this effect.

3. Conduct of the Caucus

The doors to the Caucus will be opened at 1pm., filing will occur between 1:00pm. and 4:00pm. The doors to the Caucus will be closed at 4:00 p.m. and no further persons will be permitted to enter. Those in line will be permitted to complete the check-in process and will be permitted to participate.

Voters in the 70th House of Delegates District who reside in the City of Richmond or Chesterfield County will participate in the Caucus at 31st Street Baptist Church, 823 N. 31st Street, Richmond, Virginia.

Voters in the 70th House of Delegates District who reside in the Henrico County will participate in the Caucus at Math & Science Innovation Center, 2401 Hartman Street, Richmond, VA Henrico, Virginia.


The Chair of the 70th House of Delegates District Nominating Committee or her designee, shall be the Chair of the Caucus and shall appoint a Secretary and such other Officers of the Caucus as is deemed appropriate.

4. Cancellation of Caucus

If no candidates file for said office, the Chair shall cancel the caucus. If one candidate files the Chair shall cancel the caucus and declare the filer the candidate. If multiple candidates file, the caucus will be convened.

5. Vacancies

If the nominated candidate dies, withdraws or otherwise refuses candidacy or if the nomination is set aside for any reason, or if no candidate qualifies for said caucus, then the 70th House of Delegates District Nominating Committee shall determine the manner by which a candidate shall be nominated and will make every effort to fill the vacancy.

6. Affirmative Action

It shall be the duty of each local precinct Democratic chair and the members of each local Democratic Committee to take all feasible steps to encourage broad participation in the selection process. Discrimination on the basis of race, sex, age, color, national origin, religion, ethnic identity or economic status in the delegate selection process is prohibited.

7. Call Distribution

It shall be the duty of the 70th House of Delegates District Nominating Committee Chair to distribute a copy of the Call to Caucus and the Candidate Filing Form to any known candidate for the Democratic Party nomination for the above listed office.

It shall further be the duty of the 70th House of Delegates District Nominating Committee Chair to cause this Call to Caucus to be publicized through the news media of Henrico County as is feasible.
